Terms of service

MindGuyMD, LLC is a Florida-registered Professional Limited Liability Company founded by Dr. Andres Vinuela, MD. The site offers two distinct services: telepsychiatry (clinical, NJ-located adults only) and mindset coaching (non-clinical, nationwide). They are billed separately and can be used independently or together.

Telepsychiatry is delivered by secure video to adult patients physically located in New Jersey, per New Jersey telemedicine law. The practice does not treat patients under 18, does not provide active substance-use detox, and does not prescribe for chronic pain. The practice is not an emergency service: in a psychiatric or medical emergency, call 911 or go to your nearest emergency room.

Mindset coaching is performance-oriented and non-clinical. It does not diagnose, does not prescribe, and does not establish a doctor–patient relationship. If, during a coaching engagement, a clinical concern arises, Dr. Vinuela will flag it and may recommend a clinical pathway — but coaching and clinical care are separate services and billed separately.

By requesting a telepsychiatry intake you consent to receiving care by secure video. You acknowledge the standard telehealth limitations: no in-person physical exam, lab work or imaging must be arranged through your New Jersey primary care physician, and emergency situations are routed to 911 or your nearest ER. Written consent for telehealth is collected at or before your first visit.

The intake and waitlist forms are designed to capture routing information only — please do not include detailed clinical history, medication lists, or other protected health information in a public-site form. Use the public-site forms to start a conversation; clinical detail belongs in the secure clinical record once intake is underway.

MindGuyMD is direct-pay. Charges are processed by a third-party payment processor; the practice does not see or store full card numbers. Telepsychiatry and coaching are billed separately, on their own tiers — they are not a bundled product. A one-time telepsychiatry evaluation is non-refundable once the visit is conducted. Monthly coaching retainers can be cancelled at any time and are not pre-billed beyond the current month; pro-rated refunds are not issued for partial months.

The practice is not an emergency service and is not a substitute for in-person emergency care. To the extent permitted by law, MindGuyMD, LLC and Dr. Vinuela are not liable for outcomes arising from a patient's delay in seeking emergency care, from a patient's failure to share relevant clinical information, or from technical failures of a third-party video or payment platform outside the practice's reasonable control.

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be handled in the appropriate Florida court, except that New Jersey telemedicine law governs the delivery of clinical care to patients located in New Jersey.
